Kelly "Marshalls" his Attacks as Black

Here are two recent miniatures, which Martin Kelly won as Black, each proving Black gambits do work! Having lost to a Lopez a few weeks earlier in Cork (Alex Lopez, that is), Kelly wins against a Lopez (Ruy Lopez, that is!)
  1. WHITE: S. Sheedy (Dublin); BLACK: M. Kelly (Belfast South) Ruy Lopez Marshall Attack - Gonzaga Championship, Dublin, 26/1/14
  2. WHITE: C. Murphy (Belfast South); BLACK: M. Kelly (Belfast South) Two Knights Defence - Belfast South Tournament, Belfast, 3/2/14.

In the second game, Kelly sacrifices two pawns, playing the same moves he would have played against the standard 8.Be2. Was this an oversight or was it a T.N. (theoretical novelty)? You decide!
